On 25 September 2023, the Regulatory Body issued a decision on a complaint by DB Cargo Belgium against Infrabel in its capacity as operator of service facilities. The complainant considered that the charges to prevent congestion risks were discriminatory and that the principle of non-discriminatory access to service facilities was violated. He also alleged that communication with Infrabel on the tariff scheme was not conducted adequately.
The Regulatory Body ruled that the complaint was admissible, but that the complainant’s three pleas were substantively unfounded.
